Learning Point #2
To file a claim with the Small Claim Tribunals, you need to make at least 4 trips to their office at Havelock Square for the following:
1. Filing of Claim
2. First Consultation (Mediation)
3. Further Consultation
4. Hearing
For the above, the Claimant will have to prepare the paperwork, i.e. Claim Form, Brief Summary of Case, Summary of Hearing, which is Sequence of Events. Do take note that the time spent does not include other work such as getting quotations for the rectification work. When filing the claim, you may include these:
1. Claim Form
2. Photos of Defects
3. Chat History
4. Quotations (for 3rd party work)
5. Contract Agreement
For my claim against Icon, I have submitted the necessary documents. Will proceed for a hearing once a date is set at the ‘Further Consultation’ session. At the hearing, the Registrar/Judge will hear from both parties, consider all points and come to a decision.
Learning Point – When we file a claim with the Small Claim Tribunals, we must be prepared that the claim may not be successful. Just like any legal case, no lawyer can guarantee that you will win. For a hearing at the Small Claim Tribunals, you present the case yourself with the supporting documents.
This will be the second time I am claiming against ICON INTERIOR DESIGN for the defects. My stand is the water leakage fell within the warranty period of 15 months from the commencement of renovation work. The leakage did not happen over one night.
ICON INTERIOR DESIGN is dismissing the claim as the warranty of waterproofing works has expired based on the time when the company was notified of the second leakage.
Regardless of the outcome, I will continue to share my learning points from both experiences. Even if ICON INTERIOR DESIGN successfully dismisses the second claim at the Small Claim Tribunals, it does not discount the facts about their workmanship and follow up services.
